STEPS FOR SUBMITTING AN ABSENCE

DESCRIPTION OF STAFF ABSENCE REASONS

Use the list below when selecting the reason for an absence:

  1. Bereavement:  Pursuant to California Education Code §4985, Leave may be granted due to death of a member of the immediate family. The Leave is not to exceed five (5) days for in-state or out-of-state travel. No deduction will be made from the accumulated Sick Leave or from the salary of the employee. Members of the immediate family include MOTHER, FATHER, GRANDMOTHER, GRANDFATHER, or GRANDCHILD of the employee or the spouse of the employee, and the SPOUSE, SON, SON-IN-LAW, DAUGHTER, DAUGHTER-IN-LAW, BROTHER, or SISTER of the employee, or any relative living in the immediate household of the employee.
  2. Comp Time: Compensatory time off may be approved in lieu of overtime pay for irregular or occasional overtime work.  Comp time must be pre-approved by the immediate supervisor.
  3. Jury Duty/Subpoena  
    1. COURT APPEARANCES UNDER SUBPOENA:  Leave may be granted to appear in any court as a witness under subpoena or any other order with jurisdiction. No deduction will be made from the accumulated Sick Leave or from the salary of the employee. A copy of the subpoena or court order must be attached to this report.
    2. JURY DUTY:  Pursuant to California Education Code §44036 and $44037, Leave may be granted to serve Jury Duty. No deduction will be made from the accumulated Sick Leave nor from the salary of the employee. All service fees received (excluding mileage) are to be submitted to the Business Department. A copy of the Jury Summons must be attached to the Report of Absence/Off-Campus Duty Form.
  4. Military Leave:  All documents required to effect such leave shall be submitted to the HR Department.
  5. Sick Leave, Family Illness:  Family member’s illness, injury, or doctor’s appointment.  Leave for family illness is deducted from available sick leave.  If you run out of all available leave, you receive a full salary deduction if you are absent due to family illness.
  6. Sick Leave, Own Illness:  Employee’s own personal illness, injury, or doctor’s appointment.  
  7. Sick Leave, Personal-Discretionary:   Two days of employee's personal necessity leave may be used as discretionary leave in accordance with bargaining unit contracts. Two days of advance notice by employee to appropriate administrator/manager is required, if possible.  
  8. Sick Leave, Personal Necessity Non-Discretionary: By indicating this personal necessity option, employee attests under penalty of perjury that the absence is only for one of the types of personal necessity leave indicated below.  A maximum of seven (7) days per school year may be granted to employees for the reasons of Personal Necessity, as defined below, which when used shall be deducted from the employee's accumulated Sick Leave. An employee may not utilize Personal Necessity Leave in the event he/she does not have any accumulated Sick Leave. 

    Listed below are the types of personal necessity non-discretionary leave:
    1. ACCIDENT OF AN EMERGENCY NATURE: Leave may be granted for such accidents involving the employee's person or property, or the person or property of a member of his/her immediate family (as defined in the Bereavement Leave statutes below). The emergency must be of such a serious nature that the immediate presence of the employee is required during his/her normal working hours.
    2. COURT APPEARANCE: Leave may be granted for the employee to appear in any court, or before an administrative tribunal as a litigant or a party in any suit. This leave is not for the purpose of serving Jury Duty.
    3. DANGER TO HOME OR PROPERTY OF EMPLOYEE: Leave may be granted in circumstances involving imminent danger to the residence of the employee occasioned by earthquake, fire, flood, or acts of God which may be serious in nature and under circumstances which the employee cannot reasonably be expected to disregard.
    4. DEATH OF A MEMBER OF THE IMMEDIATE FAMILY: Leave may be granted when additional Leave is required beyond that provided by Bereavement Leave.
    5. EMERGENCY EVENTS: Leave may be granted for such emergency events that may be unavoidable and or a serious nature involving circumstances which the employee cannot reasonably be expected to disregard, or which may not be conducted at a time other than his/her regularly assigned duty hours.
    6. FUNERAL: Leave may be granted to attend the funeral of distant relative, friend, or acquaintance of the employee.
    7. ILLNESS IN THE IMMEDIATE FAMILY: Leave may be granted in the event of serious or critical illness or injury of a member of the immediate family, as defined in the Bereavement Leave statutes below, calling for services of a physician.
    8. PATERNITY LEAVE: Leave may be granted when the presence of the father is needed at the time of adoption or birth of his child, or when birth may be considered imminent.
